TBS 2011 Regulations

1 INTRODUCTION

1.1  The Business Street is an initiative of the International Rome Film Festival (October 27th - November 4th, 2011), a Fondazione Cinema per Roma production, entirely dedicated to screenings and meetings for audiovisual industry professionals.

1.2  The Business Street will run from October 27th – October 31st, 2011 and will be held at the Hotel Bernini Bristol, Hotel Majestic, the Auditorium, movie theatres in Rome and other locations in the Via Veneto area.

1.3  Participation in The Business Street implies acceptance of these regulations; any violation of the said regulations will lead to a withdrawal of the accreditation badge.

1.4  Admission to The Business Street and accreditation is subject to the procedures henceforth described. All final decisions lie with Fondazione Cinema per Roma (henceforth referred to as Fondazione) as  represented by The Business Street Director. 

1.5  The Business Street Director reserves the right to settle all disputes not explicitly set forth in these  regulations, and to waive the provisions of the regulations only in specific and well-motivated cases. Should any dispute arise regarding the interpretation of the provisions of the regulations, the original  Italian language text shall be binding.



2 ACCREDITATION

2.1 The Business Street Accreditation is open to:

- international distributors;
- buyers (broadcasters, distributors, exhibitors, etc.);
- national or regional institutions which handle audiovisual promotion, marketing and International sales;
- producers (executives, creative executives, legal and/or financial executives).

Please note that accreditation is not open to persons under the age of 18 because the majority of the films screened at TBS have not been viewed by the Italian ratings board and thus cannot be shown to minors.

2.2  Participants can apply by filling out the online accreditation form (www.romacinemafest.org), and returning it with the requested documentation (a company profile along with job description for persons applying for company accreditation and curriculum vitae for individuals) no later than  October 3rd,2011.

2.3  Accreditation forms will be accepted on a first-come-first-served basis. The Fondazione will confirm its acceptance of the request for accreditation by e-mail.

2.4  Badges are strictly personal and non-transferable. If someone is found wearing a badge other than his/her own, such badge will be confiscated and not returned.

2.5  Lost or stolen badges must be reported to the Fondazione accreditation desk. The replacement of a Badge will cost €50.00.

2.6  Name changes of people attending The Business Street will be accepted, subject to written notice sent to the organization (by fax: +390640401779 or e-mail: accreditation@romacinemafest.org) no later than October 3rd, 2011. The request will be confirmed in writing (by fax/e-mail) by the Fondazione. However, no name changes will be considered for requests received after the above deadline.

2.7  Please note that applications neither guarantee nor constitute accreditation for The Business Street. The Fondazione will give each application the utmost consideration; however, the organization reserves the right to grant accreditation according the procedure illustrated herein and at the sole discretion of The Business Street Director, whose decision is final.

2.8  For the duration of The Business Street, professionals may apply for daily badges, submitting their request 24 hours in advance.

Applications will be granted on the basis of the terms and conditions for accreditation set out in the present Regulations and are subject to availability.



3 PAYMENT

3.1 The Business Street Badge can be purchased for €230.00, while the Daily Badge costs  €100.00 a day; all prices include  20% VAT.

3.2 Payment may be made in advance (by bank transfer or online with a credit card), or at the registration desk upon collection of the badge (by credit card/debit card or in cash).

3.3 Payment instructions will be provided in the letter of confirmation sent by the Fondazione in accordance with article 2.3 (see above).

3.4 Invoices for the registration fee will be sent to the address provided by the participant in the registration form.

3.5  Accreditation will be granted to individuals and companies who are in arrears with the Fondazione Cinema per Roma upon payment of the debt previously contracted.



4 BADGE PICK-UP

4.1  Badges can be collected at the accreditation desk at the Hotel Bernini Bristol, upon presentation of  valid identification and confirmation letter (sent by e-mail).

4.2  In order to collect a badge on behalf of other participants, the proxy should present: e-mail confirmation letter, written authorization from person delegating him/her to collect the badge, a hard copy of the delegating person’s ID, and his/her own valid ID.



5 CANCELLATIONS

5.1  If an accreditation is cancelled by October 3rd, 2011 (in writing by fax or e-mail), the party will be refunded the full amount paid to purchase the badge.

5.2  The Business Street organization is entitled to retain the total amount paid for each badge cancelled after the above-mentioned date.

 

6 DATA PROTECTION

6.1  Information concerning contacts, addresses, activity, profession and job title of individuals and/or companies will automatically be gathered from the online registration form filled out by the applicants themselves, and automatically saved to the Fondazione Cinema per Roma database.

6.2  If the accreditation request is granted, the information described in 6.1 above will be partially or fully published in print materials produced by the Fondazione and on the website, in the password-protected area (for a non-comprehensive illustrative purpose: the TBS catalogue, lists of participants, etc.).

6.3   In order to limit or exclude his/her personal information from the print materials published by the Fondazione or the website, the badge holder must make a written request to business@romacinemafest.org no later than October 3rd, 2011.

6.4 The Fondazione takes no responsibility for incomplete or inaccurate data and information provided in the above-mentioned materials, in the event they are the result of inaccuracies and/or omissions contained in the badge holder’s application form.

6.5 Only those participants whose application for accreditation is received by October 3rd, 2011, will be mentioned in the printed TBS catalogue, the Industry Guide. The Business Street cannot guarantee that participants who request accreditation after the October 3rd, 2011 deadline will be mentioned in the Industry Guide; they will only  be mentioned in the password- protected area of the website.

6.6 Upon confirmation of accreditation, TBS badge-holders agree to receive informational and promotional material concerning the International Rome Film Festival and The Business Street (for example, for a non-comprehensive illustrative purpose: information via e-mail, text messages or fax).

6.7 Please note that the names of participants attending TBS screenings or viewing films in the Video Library will be provided to representatives of the films.

 

The Business Street Screenings: General Information

7   FILMS UNELIGIBLE FOR THE BUSINESS STREET

7.1 THE FOLLOWING FILMS ARE NOT ELIGIBLE FOR SUBMISSION TO THE BUSINESS STREET:

a) Films which have been released before January 1st, 2011 (this includes participation in film festivals, film markets, or showcases);
b) films produced before December 31st, 2009;
c) Films made in languages other than English without English subtitles; original English-language films may be subtitled in Italian or French;
d) Films of a blatantly pornographic nature, or those which advocate violence or openly incite violation of human rights;
e) Films which infringe copyright or break international regulations concerning the ownership of intellectual property;
e) Short films (by which is intended a running time of 50 minutes or less);
f) Series of promos and presentations that last less than 50 minutes.



8 FILM SUBMISSIONS

8.1  Companies submitting a film to The Business Street must also purchase a Business Street badge (see section 2, “Accreditation”).

8.2 Producers, distributors or other parties presenting films at The Business Street must be entitled to do so by holding all the relevant and reserved rights to represent the aforementioned films, and they must declare and guarantee that they have been legitimately authorized to submit the film to The Business Street.

8.3 Having read and accepted the present Regulations, all parties submitting a film to The Business Street shall declare and guarantee that they possess all reserved rights for the film and likewise they undertake to indemnify and hold harmless the Fondazione and its entitled parties from any present or future claim from, and any liability towards, third parties that could arise from the screening of the submitted film at The Business Street.

8.4 Films to be screened at The Business Street should be submitted using the official online entry form (www.romacinemafest.org ), which must be duly completed, signed and returned by fax (+390640401779) no later than Monday, October 3rd, 2011.

8.5  The Fondazione will send a written confirmation of acceptance (by fax or e-mail) for the screening of the film at The Business Street; only following acceptance by written confirmation can a film be considered officially admitted to The Business Street.

8.6 Once the film titles have been officially admitted to the Business Street, they will be entered in the Industry Guide and in the password-protected area of the website. The film information published on the aforementioned website and in printed materials will be automatically gathered from the online film entry form filled out by the applicant. The organizers shall not be held liable for inaccurate or missing information published in the guide, originating from errors or omissions reported in the film entry form.

8.7 Film submissions arriving after the  October 3rd, 2011 deadline, will be considered on the basis of the screening slots still available (if any). Last-minute film entries will be listed on the festival website only.

8.8 Should participants wish that their own titles should not be mentioned in materials published by the Fondazione (or else mentioned with restrictions concerning access to screenings), they must make a written request to business@romacinemafest.org no later than October 3rd, 2011 (cf. art. 10.4).

8.9 The organization cannot be held responsible for delays or cancellations of the screenings if the technical data requested for programming and provided by the submitters, is incomplete or inaccurate.

8.10 Submission is open to feature films as well as medium-length works.

8.11 As a general rule, a maximum of 2 screenings per title may be requested; the Fondazione reserves the right to book the second screening at its own discretion, according to screening slot availability.

8.12 Screenings will be granted to individuals and/or companies who are in arrears with the Fondazione Cinema per Roma only after payment of the debt previously contracted.



9 PROGRAMMING

9.1 Screening requests for films admitted to The Business Street will be processed on a first-come-first-served basis.

9.2 The Fondazione reserves the right to give priority to films premiering at The Business Street and /or to international premieres screening in the official sections of the International Rome Film Festival.

9.3 Films which have already participated in TWO international film markets will not be prioritized and will be programmed according to screening slot availability.

9.4 Although scheduling requests from participants will be held in the utmost consideration, the Fondazione reserves the right to set screening schedules (dates, times, theatre and numbers of screenings per title) as it best sees fit. Final decisions regarding the screening schedule are at the sole discretion of the Fondazione.



10. ACCESS TO SCREENINGS

10.1  The Business Street screenings are reserved for professionals accredited to TBS and their guests presenting ‘invitations’ with the Festival and/or TBS logo that have been validated by the TBS staff.

10.2 The personnel stationed at the theatre entrances will be uniquely responsible for the enforcement of art. 10.1. Any other operations involving filtering of attendees (cf. 10.4) must be handled directly by the parties entitled (producer or international seller who has correctly submitted a film to The Business Street).

10.3  Rights holders may request from TBS staff official ‘invitations’ to their screenings for non-accredited professionals. Please note that access to screenings is prohibited to persons under 18 even if they have an invitation, since the majority of the films screened at TBS have not been viewed by the Italian ratings board and thus cannot be shown to minors. Written request for above invitations must be made to TBS staff at business@romacinemafest.org at least 48 hours before screening date.

10.4  Rights holders may request limited access to screenings of their own films at TBS (for example, invitation-only or exclusive private screenings) as per written request to TBS staff at business@romacinemafest.org. If no mention of the aforementioned screenings is to appear in the materials published by The Business Street (or else they are to be flagged as ‘invitation-only’), such request must reach TBS by October 3rd, 2011.



11. VIDEO LIBRARY

11.1 The films screened at The Business Street will be featured in the Video Library (except for those titles which the rights holder specifically requests to be excluded by checking the relevant box in the film submission form). The ‘normal ingest’ process will be handled by The Business Street at its own expense.

11.2 Accredited international distributors may also include to the Video Library titles for which they have not requested TBS screenings. In this case, a special form must be filled out, the link to which will be available online (www.romacinemafest.org ). This form must be filled out, printed, signed, and sent by fax to the following number: +390640401779 no later than Monday, October 3rd, 2011.

11.3 In order to include one’s own title in the Video Library, the rights holder must send a copy of the film (with English subtitles, if the original version is not English) by October 17th, 2011, to the following address: Fondazione Cinema per Roma, Uffici Cinema, Viale Pietro de Coubertin, 10 – 00199 Rome (Italy), specifying ‘Re: TBS Video Library 2011, to the attention of Francesca Palleschi’.

11.4 The formats for sending copies of films for the Video Library are the following:

a)  File type: .WMV, Resolution: 720 x 579, bitrate: 1.5 M;

in the event the file does not possess the above characteristics, in order to create the file the Fondazione needs to receive the films in one of the following formats (either is acceptable):

b) Beta cassette of film (either DigiBeta PAL or Beta SP PAL)  or else

c) DVD of film (we recommend sending DVDs created in a laboratory, not computer-mastered).

11.5  For further information on the Video Library, please contact videolibrary@romacinemafest.org.



12 FORMATS

12.1  Films can be presented in the following formats:

- 35 mm

- 2K D-Cinema

- E-Cinema (Beta SP, Beta Digital NTSC/PAL, HD, HD Cam, HD Cam SR, DVD)

12.2  Only DVDs created in a laboratory and not computer-mastered will be accepted.

12.3  Further instructions and information concerning technical specifications for formats will be provided by the relevant office at the Fondazione upon confirmation of the market screening.



13 SCREENING FEES

13.1  The screening fee must be paid in advance by wire transfer no later than Friday, October 21st, 2011.

13.3  Each additional  30’ ( min.) will be subject to an extra charge of  € 50.00.

13.4  All the above prices include 21% VAT.

13.5  Payment instructions will follow after confirmation from the Fondazione of acceptance of the submitted title to The Business Street.

13.6   Invoices for the screening fee will be sent to the address provided by the participant in the online film submission form.



14 DISPATCH OF MATERIALS AND DEADLINES

14.1  Film materials (35mm copies and videos) must reach The Business Street, at the sender’s expense, no later than October 17th, 2011.

14.2  In order to guarantee the quality of the screenings, materials will be checked upon arrival. This technical check will not be guaranteed for films received after the aforementioned deadline.

14.3  The Fondazione shall not be held responsible for any flaws, delays or cancellations of screenings of films the materials for which arrive after October 17th, 2011

14.4 The address of the Festival’s film storage facility, along with the Festival’s recommended shipping instructions, will be forwarded to the participant upon confirmation of the screening by The Business Street organizers.

14.5 The sender must inform the Fondazione by e-mail (prints@romacinemafest.org) of the film title, date and details of the shipment, according to specifications in the aforementioned shipping instructions.

14.6 The Fondazione will package the materials of the films screened at the conclusion of The Business Street  event and hold them ready for pick up.

14.7 If the participating company does not have its own trusted shipping company, the Fondazione will arrange for the Festival’s shipping agent to handle the material. The return shipping costs will be borne by the owner of the material.

14.8Upon registration, the film submitter should inform organizers of the destination of the print following its screening in Rome by filling out a specific section of the online film entry form. In any case,  the film title, date and details of the print’s return shipment must reach the organization in due time, no later than October 25th, 2011.

14.9 The Business Street shall not be held responsible for any delay in the return shipment of the materials, if such a delay is incurred due to the inaccuracy or incompleteness of the print owner’s instructions or insufficient notice provided of the above information.



15 MATERIALS NOT RECEIVED

15.1 If material for films admitted to The Business Street – whether they be 35mm copies, BETACAM SP, DigiBeta or HDCam -- do not reach The Business Street at least 72 hours before their programmed screening, the organization reserves the right to cancel the screening. In this case, the full cost of the screening reservation will be charged to the participant who requested it.                                                                                                                                         



16 SPECIFIC INSTRUCTIONS FOR DIGITAL CINEMA

16.1 Copies of films sent in Digital Cinema Package format must conform to current DCI specifications and SMPTE standards.

16.2 Digital copies must be sent to the Fondazione only on portable hard disk drives in the JPEG 2000 format, formatted exclusively in NTFS and EXT3 formats, and must include all related interfaces (data port and cables) necessary and compatible with digital cinema presentation systems.

16.3  The DCP must contain subtitle track files and audio parameters.

16.4  The DCP must include one title only and no other content.

16.5  If the DCP requires Key Delivery Message (KDM), the KDMs must allow for the screening of the film as well as a quality check for the film. The KDMs’ validity must start 7 days before the date of the first screening, and must expire on the following day. KDMs can be sent by e-mail to prints@romacinemafest.org .

16.6 DCPs, like other screening formats, must reach the Fondazione no later than October 17th, 2011. In the event the DCP, or the respective KDM, does not arrive within 72 hours before the first screening, The Business Street reserves the right to cancel the screening. In this case the entire cost of the screening reservation shall be borne by the participant who requested it.

16.7 Further instructions and information concerning DCPs will be provided by the relevant office at the Fondazione upon confirmation of the market screening.

16.8 If a participant decides to send and screen the copy in DCP format, it is mandatory to send the Fondazione a back-up copy in another format.



17 CANCELLATIONS

17.1 Programmed screenings may only be cancelled by prior written notice sent by fax (tel. +39 0640401779) or   e-mail (business@romacinemafest.org).

17.2 Cancellations will be accepted up to Thursday, October 20th, 2011. For any cancellations after this date, the full cost for the screening will be charged to the participant who requested the cancellation.



18 LIABILITY OF THE BUSINESS STREET

18.1 Insurance costs for the shipping of screening materials to The Business Street and their return shall be borne by the company or individual that submitted the film to TBS.

18.2 The Fondazione guarantees insurance coverage against all risks for the period in which the film is on The Business Street premises.

18.3  In case of loss or damage of a 35mm print during The Business Street event (October 27th - 31st, 2011), the Fondazione Cinema per Roma will pay the printing costs for a new copy according to current market rates for developing and printing film in laboratories.

18.4 Participants who send material for screenings should commit to adopting quality standards for the presented formats. The Fondazione cannot be held responsible for screening delays or cancellations caused by technically defective materials.

18.5 The organizers disclaim all responsibility for defective BETACAM SP, DIGIBETA or HD Cam’ materials.
18.6   Any claims for damaged prints must  be immediately notified in writing to the organization by fax  (+39 0640401779) or e-mail (business@romacinemafest.org). Claims received after November 30th, 2011, shall not be taken into consideration.
